Just checked an old, mostly unused email account and noticed this email from the domain information service I use to keep my personal information private.
Not sure what it’s about, really, and how we’re involved.
This email is to inform you that we have received a properly formatted subpoena for documents in the following civil action: William Vandry v John Does issued by the Henrico County, Virginia Circuit Court, Case No. CL10-3498. Our response to this subpoena may require us to disclose some of your personally identifiable information. I have just checked my email account and found your letter regarding a subpeona for information regarding myself.
I first need to contact my attorney about this matter. (not the other side’s attorney) please provide me with a copy of the subpeona that was served on you, the date it was served, and any information about me you have provided to Mr. Rivera up until this date.
It might be worth it, but talking to Vandry before looking at the relevant documents is asking for trouble. We don’t even know yet whether he is, or is not suing you.
What is the direct email for the complience officer Phrost, and was the email sent to you on DECEMBER 23, 2010!

My name is Samuel P. Browning and I am an attorney representing both Bullshido.net and sociocide.com I have just been advised by my client that you have received a subpoena from one Domingo J. Rivera Esq concerning what appears to be Bullshido.net.
This subpoena was obviously filed over the holiday season, to impede a timely response so I ask you to waive your three day time limitation on objecting to this subpoena before providing such information to above mentioned counsel. Lets see, I learned today for me to appear pro-hoc-vic in Virginia I would have to post a non-refundable bond of $250, and that doesn’t count hiring someone to let me appear under their license. But first questions first, are you willing to spend $250 on this Phrost.
Second question, what is Nick’s contact information? I may need a couple thousand dollars to hire someone in Virginia immediately.
Why?
Because I called the clerk of the court and she would not read me the complaint over the phone so I still don’t know who is being sued other then John Doe 1-10, which may include you, and Bullshido or it may not.
I depart to send an overnight mailer to try to get the operative document.
By late Wednesday I need to get a copy of the complaint and figure out if we are a party.
If we are not a party, we need to figure out whether we are willing to disclose IP information on posters on the thread. The person may also demand the poster’s onsite email, which I definately do not want to provide. But that may be a demand by them.
If they want the Vandry thread down, okay, we can survive. The lawyer may also demand money, this is a bad idea because he may then find another client, pull the same thing and demand another Bullshido payday.
I have talked to Scrapper, I’ll be trying to set up a legal defense account tomarrow or Wednesday.
I talked to Nick, Nick may be willing to back a defense, but if taking a thread down saves him having to spend thousands he wants the thread taken down.
We will need to make a public announcement to kick off a fundraising campaign. Once we do that, backing down becomes much more of a problem because then others may see the results and hire this guy.
So Phrost think about whether you are willing to give up:
A thread
A poster’s IP
A posters mail account
Money
in order to resolve this. The alternative is putting together the best defense we can, and that’s going to costly.
