Guys, at a guess, using the innacurate term “Dojo Press, Inc” might break the “Florida’s Deceptive and Unfair Trade Practices Act”. I’m not familiar with that legislation but the fact that TNK (the purchaser) is not in Florida might be an issue: http://library.findlaw.com/1999/Nov/1/126085.html
The act defines the term person as “an individual, partnership, corporation, association, or other entity doing business in Florida” (Emphasis supplied). F.S. §817.416(1)(a). Inasmuch as the private right of action afforded under subsection (3) of the act is expressly limited to “any person,” the aggrieved purchaser must be “doing business in Florida.”
No appellate court has squarely discussed the issue of whether the act applies to govern a dispute between an in-state franchisor and an out-of-state franchisee. However, four federal district courts in Florida have dealt with this issue, albeit with inconsistent results.
That legislation might be a useful anvil to apply further moral leverage over Ashida.
We went through this topic at some length in a previous thread. I searched every state online corp check i could get to work -47 states IIRC. No trace on “dojo Press” as a company (quite sure of that) and aslo tried to find "Ashida Kim, Radford Davis, Redford Davis etc etc as directors, again able to check most states. Researched Florida incorporation rules and agree re the PPOB requirements. Also you are not allowed to use a “fake name” as a director.
Basically, if he is incorporated, it’s not as “Dojo Press”.

The Department of State’s Division of Corporations also has a Public Inquiry Line at (850)488-9000 for Florida Corporations. Select menu item #1.
That’s the line consumers would use to complain about corporations.

I don’t know about florida, but here a corporation can “do buisness as” something else, like “Taxshelter Inc. DBA Max’s Camera Free Tanning Parlor”
