I was wondering about the wisdom of this thing in light of possible civil litigation myself. It’s all fun till someone decides to sue. I’m guessing WK was wise enough to draw up a waiver and the lawyers saw that this could be a bad idea.

that is intimidation and coercion. it is a huge legal mess, and if he got hurt in the match, then i would be fucked. i suggest everybody on bullshido stop talking about substituting for me, friendly skill assessments, or anything else involving dan bowen.

Just as a matter of interest (‘mind your own damn business’ is an acceptable answer and fair play to you if you don’t wanna say anything else) but how did it become apparent that someone had threatened Dan on your behalf without your knowledge? If Dan says that he wasn’t threatened/didn’t interpret it as a threat, I mean…

person a and person b were talking about the challenge. person a threatened dan and told person b. person b told me. i asked person a and they admitted they did it. dan says person a did not do it.
person a has no reason to lie or incriminate himself, so i can only assume that dan did not immediately interpret “fight whitekimbo or else” as a threat, or he has ulterior motives for denying it happened.
that is not the issue. the issue is a coercive and intimidating threat was made. i handle my challenges the same way i handle jewish converts.
if i suspect, for any reason, they are being coerced into it, they don’t get what they came for.

Ugh, a few jokes were made concerning comforting your wife after WK pounds you to dirt, and about making a move at your girls when they turn 18. There are lawyers who specialize in martial arts law, and I hope you are talking to them. (There are many parallels between the law and other martial arts - for example, the best way to improve is in contest with a live opponent.) In no way is anything I state here intended to be legal advice of any kind, etc.
You guys often say “video or it didn’t happen”. Well, in this case it should be “case law or it didn’t happen”. Show a case in any relevant jurisdiction where a person was prosecuted for someone else writing a threatening email without the person’s knowledge or consent - especially in similar situation as WK - who has consistently disclaimed any intent to do anything outside of a sport competition ring. Show a case in any relevant jurisdiction where a person has been able to defeat a liability waiver for duress based on a email with vague threats, especially when the parties have both consistently claimed to want to enter into the contract.
There is always a risk of being sued, and I am sure that if you asked most lawyers (or hell, most people) if it is a good idea for you to fight someone who called you out on an internet thread, they would say no. But with Dan Bowen’s course of action in starting the challenge, accepting you as the challenger, etc, there is no way that anyone could say that he was coerced into entering into the challenge - there are too many pre-“alleged threat” statements. And if D-Bo makes enough statements that show that he is voluntarily entering the sport contest, with non-Bullshido witnesses, one would think that would be sufficient to defeat any later claim of duress, but that’s just conjecture, not advice.
