I guess now we know. At least two students have been on a road trip all over the country serving papers. Must cost a lot with the cost of gas these days. Read Trip too Far for more info.

Check Fed. Rules of Civil Procedure #4 for service requirements. They might have to be deputized as process servers or be the Plaintiff himself. Can’t remember it off the top of my head.

Oh, that is old news. It is in fact, true that two of his little goons went around several states and served papers. I know this because my wife and daughter were the victims of this “process serving” behavior. Well time has gone on and that lawsuit was dismissed in federal court. What did he do, refiled it in State court. Now let me think, the federal court dismissed it on jurisdictional issues and somehow the state of Tennessee is going to find a jurisdiction that the feds didn’t? Well, this time around they did have to use appropriate service to get it done, though they served at least three people themselves, in violation of the state laws in the state they were in at the time. And how do I know this you might as? Why because I am one of the people named in the lawsuit. This isn’t costing me anything because I have a friend who is a lawyer, who interestingly enough, has privileges to work in Tennessee. Oh well, the sad thing is that this is a clear example of the misuse of the legal system but most of the people being sued have had to spend money to defend themselves. On at least three occaisions, certain people named have been offered “deals” to be left alone, one included making a promise to never mention the name or discuss konigun for 40 years. HMMMmmmmm, not bloody likely.

A-holes like this cost people money to defend when he probably got some snot-nosed punk one year out of lawschool who hung out a shingle and said “open for business” who doesn’t know his ass from his elbow.

I mean the legal system here allows jackholes like aishida kim or dallas or even coda to manipulate the system with the “threat” of a lawsuit that no matter how frivolous, still costs money to defend and even if you move for legal fees, courts are unlikely to give them to you even if it is dismissed early.

If bullshido does ever get much bigger then this is going to be a factor to be dealt with.

Sad part is, unless they are total liars, it will even create problems for rooting out frauds who aren’t clear cut guys like this as someone highly questionable but not a “glaring” wacko might be able to pull a good show for a judge who doesn’t know his ass from his elbow in martial arts (and most things IMO- unless they are federal).

We actually have dealt with it in the past and have things in place that would make it very painful for someone to try similar tactics with us. Beyond that, I can’t speak on the subject.

E-budo itself was not served in state, as verses federal court.
